The dissolution of a marriage that once seemed ordinary has been finalized against an extraordinary backdrop. Brittany Fortinberry, the former Indiana math teacher accused of sexually abusing multiple teenage students, is now divorced from her husband Nicholas Fortinberry. The decree was completed on August 25, according to TMZ, more than a year after Nicholas first filed to end the union as the criminal investigation into his wife began to unfold.
Fortinberry, 33, remains jailed while awaiting trial on 47 criminal charges. Prosecutors have alleged that she abused her position of trust at Eminence Schools, engaging in inappropriate relationships with students over an extended period. Investigators believe at least six students have come forward as victims, according to charging documents cited by the New York Post.
The allegations are stark. Fortinberry is accused of supplying minors with alcohol and psychedelic mushrooms before engaging in sexual activity. One teenage boy told authorities that she invited him over to use drugs, complimented his appearance, and later initiated sex with her in the garage. He claimed she then returned to bed with her husband while he slept in the children’s room. In another incident, some students were reportedly instructed to wear masks resembling those from the “Scream” film franchise.
Court records show the charges include sexual misconduct with a minor, dissemination of material harmful to minors, contributing to the delinquency of a minor, and sending sexual messages and videos to 17- and 18-year-old boys who served as her teacher assistants. If convicted on all counts and ordered to serve consecutive sentences, Fortinberry could face life imprisonment.
Through the legal process, Fortinberry has denied the allegations. She remains entitled to the presumption of innocence unless proven guilty, a principle that will be tested in court.
The divorce settlement, as reported by TMZ, awarded Fortinberry her personal belongings, including clothing, shoes and makeup. Nicholas Fortinberry retained ownership of a 2022 Chrysler Pacifica and a Toyota 4Runner. The agreement grants Nicholas sole legal custody of the couple’s child, though custody arrangements could change if she is released from custody before the criminal proceedings conclude. The couple also sold their shared home and agreed to divide the proceeds.
Nicholas Fortinberry filed for divorce in February 2025, around the time authorities began investigating the allegations against his wife. The finalization of the divorce marks another step in the unraveling of a life that, for many in the community, now seems defined by the charges she faces.
