Expelled MK Leader Jabulani Khumalo Loses High Court Bid for Reinstatement

Expelled leader of the uMkhonto weSizwe party, Jabulani Khumalo, has faced another legal setback as his bid to be reinstated in the party has been rejected by the Western Cape High Court.

This marks a second defeat for Khumalo, who founded the MKP, as the Electoral Court dismissed his application for reinstatement as a Member of Parliament.

The court deemed Khumalo’s legal arguments frivolous and lacking in substance, resulting in the dismissal of his case.

On Wednesday, the Electoral Court in Johannesburg dismissed Khumalo’s plea, highlighting the deficiencies in his claims.

In his application, Khumalo contested the decision by the Independent Electoral Commission of SA to replace him with former President Jacob Zuma as the party leader.

Judge Lebogang Modiba, presiding over the case, pointed out the contradictions in Khumalo’s arguments regarding key dates and events.

According to the judge, Khumalo’s version of events regarding the IEC application and Zuma’s involvement lacked consistency.

Khumalo alleged that a letter forged by Zuma’s daughter, Duduzile Zuma-Sambudla, led to his removal from the MKP’s records at the electoral commission.

The court found Khumalo’s case to be an abuse of legal process and a waste of resources, hence ruling in favor of the respondents and imposing costs on Khumalo.

Meanwhile, Zuma-Sambudla expressed her intention to pursue defamation proceedings against Khumalo for his actions that she deemed detrimental to her reputation and that of the MKP.

Advocate Thabani Masuku, representing Jacob Zuma, labeled Khumalo’s application as ‘hopeless’ during the court proceedings at the Western Cape High Court.
