Legal Battle Ensues Over Showmax Docuseries 'tracking Thabo Bester'

Thabo Bester and Dr Nandipha Magudumana find themselves in a legal showdown over the imminent release of the controversial Showmax docuseries ‘Tracking Thabo Bester’. The high-stakes battle is set to unfold in the Johannesburg High Court as both parties seek to halt the streaming of the series, scheduled for Friday evening.

Bester and Magudumana’s legal representatives are urgently seeking interdicts to prevent Showmax from airing the documentary until they have had an opportunity to review its contents. Bester specifically aims to block any segments that delve into his personal life, prior convictions, and ongoing criminal trial proceedings.

Showmax, on the other hand, argues that the series is based on information already in the public domain and is of public interest. The streaming service contends that halting the release would impinge on their freedom of expression and accuses Bester of seeking financial gain through his legal actions.

In his affidavit, Bester expresses concerns that the docuseries could compromise the fairness of his trial by presenting evidence not yet disclosed to him. He insists on being treated fairly despite his past convictions and asserts his right to a fair legal process.

Magudumana, on her part, fears that the documentary’s portrayal of potential trial witnesses could impact her criminal proceedings. She emphasizes her right to dignity and respect, accusing Showmax of prematurely condemning her before the trial commences.

Steven Budlender SC, representing MultiChoice Group, the parent company of Showmax, refutes the claims made by Bester and Magudumana. Budlender argues that the legal threshold for prior restraint has not been met and asserts that the documentary’s content is already in the public domain.

The case is slated to be heard in the Johannesburg High Court before Judge Stuart Wilson, with both parties gearing up for a contentious legal battle. The outcome of this showdown could have far-reaching implications for the boundaries between freedom of expression and fair trial rights.
