LOS ANGELES, CA — Stunt performer Devyn LaBella has filed a lawsuit against actor and director Kevin Costner, claiming sexual discrimination and harassment following an incident on the set of “Horizon: An American Saga – Chapter 2″ in May 2023.

LaBella asserts that she was unexpectedly subjected to a brutal rape scene without notice or consent, and without the presence of a mandatory intimacy coordinator, which was part of her contract. The complaint details how, after reporting the incident, she did not receive further work on the series and was allegedly blacklisted by the film’s stunt coordinator.

“On that day, I was left exposed, unprotected, and deeply betrayed by a system that promised safety and professionalism. What happened to me shattered my trust and forever changed how I move through this industry,” LaBella said in a statement.

Costner’s attorney, Marty Singer, has dismissed the allegations, stating the lawsuit is “without merit” and contradicts LaBella’s actions and statements following the incident. He emphasized that Costner prioritizes safety and comfort on his film sets.

The lawsuit follows a separate legal issue involving Costner’s production company, which is also dealing with allegations of breaching a financing agreement. LaBella’s case highlights broader issues regarding the protection of performers in Hollywood, especially in light of the #MeToo movement.

Legal representation for LaBella, including the Time’s Up Legal Defense Fund, aims to shed light on the need for better intimacy coordination on film sets. Jennifer Mondino of the fund stated, “The guidelines that are supposed to be followed on regular movie sets weren’t being followed.”

If the case goes to trial, it may have significant implications for industry practices regarding safety and consent for performers in intimate scenes.
