Nashville, Tenn. — Laura Prepon is facing serious allegations from her estranged husband, Ben Foster, amid their ongoing divorce proceedings. In an amended divorce petition filed on March 21, Foster accused Prepon of “inappropriate marital conduct” following their separation last September.

Foster, who filed for divorce in November 2024 after six years of marriage, cites that Prepon’s behavior has created an “unsafe and improper” living environment. According to court documents obtained by multiple outlets, Foster accused the Orange Is the New Black star of “cruel and inhumane treatment.”

In response, Prepon, 45, denied the allegations and filed her own counter-complaint contending that Foster, 44, is guilty of “habitual drunkenness.” She has requested primary custody of their children, Ella, 7, and a recently unnamed son who is 4 years old.

Foster’s initial petition claimed irreconcilable differences as the reason for their divorce, but his recent filing adds serious allegations that could impact custody arrangements. He has requested both joint custody of the children and enforcement of their prenuptial agreement.

The couple’s separation date is recorded as September 9, 2024. Since the split, they have engaged in a highly publicized legal battle regarding the care of their minor children. In January, a temporary custody agreement was implemented, restricting each party’s alcohol consumption near the children.

“Neither party shall consume alcohol to the point of intoxication while around the minor children,” the order stated. Both parents are also required to give reasonable notice for any work-related travel that may affect parenting time.

Prepon, who has expressed her desire to shield her children from public scrutiny, emphasized the importance of their well-being during these proceedings, stating, “This is in the children’s best interests” in her court filings.

Foster’s attorney, Rose Palermo, has defended her client against Prepon’s accusations, labeling them as falsehoods and expressing concern that such claims could harm their children. “Her actions will continue to harm the children who have always been Ben’s first priority,” Palermo asserted.

The couple initially sparked romance rumors in 2016 and got married in 2018. They have kept much of their relationship private, especially concerning their children. Prepon previously commented, “Everyone is different with pictures of their kids… for my husband and I, that’s where we do remain extra private.”

As the legal battle rages on, public interest in the couple’s separation continues to grow, highlighting the complexities of high-profile divorces.
