Elon Musk Sued for Sole Legal Custody of Alleged 13th Child

NEW YORK – Ashley St. Clair has filed a lawsuit against Elon Musk seeking sole legal custody of their alleged child, R.S.C., born in September 2024. The lawsuit was filed on February 21, 2025, in the New York Supreme Court, where she claims that Musk’s minimal involvement in the child’s life necessitates her request for custody.

In the filed petition, St. Clair states that Musk has only met R.S.C. three times, with the last visit taking place on November 30, 2024. She alleges that he was absent at the child’s birth and has had no substantial impact on his care and upbringing.

St. Clair, 26, asserts that she and the 53-year-old Musk began their romantic relationship around May 2023, which led to the conception of R.S.C. following their intimacy in January 2024. Although she recognizes Musk as the father, she has also submitted a paternity petition to confirm his legal responsibilities.

The petition includes text messages that St. Clair claims demonstrate Musk’s acknowledgment of his parentage. One such message, sent shortly after the birth, reportedly stated, “I look forward to seeing you and him this weekend.”

“Ashley St. Clair has filed paternity and custody petitions to protect the best interests of her child,” said her representative, Brian Glicklich. “She has made every effort to collaborate with Mr. Musk before taking this step.” In the statement, Glicklich noted that St. Clair’s current focus is on her child’s welfare, and she would not comment further on the lawsuit.

In an additional part of her filing, St. Clair includes her attorney’s affirmation, which describes attempts to resolve the custody issue privately with Musk’s representatives. Karen B. Rosenthal, St. Clair’s attorney, stated that Musk’s legal team has not responded sufficiently to settle outstanding issues related to custody and support.

Musk is currently embroiled in another custody dispute involving his three children with singer-songwriter Grimes. Tensions have surfaced, with Grimes publicly expressing concerns regarding one of their children’s medical needs on social media, pleading for Musk to respond.

As the billionaire continues to face legal challenges, including St. Clair’s allegations, he has made only a cursory acknowledgment of the proceedings. On social media, he responded to speculation regarding his numerous children by stating, “Whoa.”

Elon Musk’s representatives have yet to respond to requests for comment regarding the lawsuit filed by St. Clair. As the case progresses, the court will determine the status of custody and paternity.
