Congressional Leaders Travel to El Salvador Amid Constitutional Crisis Over Deportations

WASHINGTON, D.C. — Democratic Senator Chris Van Hollen of Maryland announced plans on Tuesday to travel to El Salvador to advocate for Kilmar Abrego Garcia, a man whose deportation has raised serious constitutional concerns. Abrego Garcia, a former Maryland resident, was returned to El Salvador under circumstances the Trump administration admits involved an administrative error.
In a statement, Van Hollen described Abrego Garcia’s continued incarceration in the Centro de Confinamiento del Terrorismo, or CECOT, as an “outrageous situation” that threatens the fabric of U.S. constitutional rights. He emphasized, “If the Trump administration continues to thumb its nose at the federal courts in this case, we’re clearly in constitutional crisis territory.”
The senator hopes to gain information about Abrego Garcia’s wellbeing during his visit. “I want to see him and ensure that he is alive,” Van Hollen said, underscoring the urgent need for transparency in the case. His trip comes after the Supreme Court ordered the Trump administration to facilitate Abrego Garcia’s return, which has not been acted upon.
Van Hollen’s efforts echo those of Representative Adriano Espaillat, who earlier requested a meeting with the Salvadoran government regarding Abrego Garcia’s case. The administration’s refusal to act has significant implications, with critics urging that it undermines judicial authority.
Abrego Garcia was deported last month despite having been granted withholding of removal by an immigration judge in 2019, due to fears for his safety in El Salvador. Accusations against him of being affiliated with the MS-13 gang are also under scrutiny, as his legal team contends they are based on unverifiable claims from a single informant.
Senator Van Hollen’s remarks are part of a larger debate within the Democratic Party regarding responses to Trump’s immigration policies, which have ignited divisions among lawmakers. Some argue that focusing on Abrego Garcia’s plight allows Trump to shift discussions away from pressing economic issues.
The political ramifications of this situation are significant, with the Trump administration facing backlash for what many view as blatant disregard for court orders and the erosion of due process in immigration procedures. Comments from the administration have reflected a stark portrayal of Abrego Garcia as a ‘terrorist,’ which has been met with skepticism by advocates for immigrant rights.
As the situation develops, the actions taken by both lawmakers and the Trump administration will likely reveal much about the current political climate and the ongoing tension between the executive branch and the judicial system.
